           What Is Criminal Intent?
          &#xD;
    &lt;/span&gt;&#xD;

           Criminal intent is simply a matter of proving that a person intended to commit the crime with which they are charged. This isn't a matter of semantics, and it's not always as obvious as it may seem to those whose main law experience is in movies or television shows. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           This issue boils down to the fact that in most cases, a crime cannot be committed by accident. If you take a suitcase from the airport because you legitimately thought it was your suitcase, you haven't committed theft. You had no intention to take what wasn't yours. However, if you discover it's filled with expensive jewelry and refuse to return it, you have then committed that crime. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           What Are Defenses Involving Intent?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;

           The example of the airport luggage mistake above illustrates a strong defense strategy. This was a mistake of fact. You believed the property to be yours but were mistaken as to the facts. An employee might keep a company computer upon termination, believing it was given rather than loaned by the employer. Or an ignorant driver may have accidentally strayed onto someone's unmarked private property. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In some cases, the defendant may have intentionally committed a criminal act, but they did so for altruistic purposes. This is less common, but it can be a strong defense. Consider a person who has been drinking at a bar. They see an unattended car rolling toward a busy intersection. If they jump in and steer the car away from other people, they have technically committed a DUI. However, their intent was not criminal but rather an act of necessity. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Other acts of necessity may be defenses to criminal charges. Were you under duress or believed you were in immediate danger? Were you with a group of so-called friends who threatened you with bodily harm if you didn't help them commit a theft, vandalism, or assault? Did you have reason to believe a family member was in imminent danger in someone's home, so you broke in? You didn't have criminal intent. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

           How Does Intent Affect Reasonable Doubt?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Most Americans are familiar with the idea that a jury must find a person guilty beyond a reasonable doubt. This doctrine generally means that a reasonable person would find that the evidence presented leads to no other logical conclusion than that the defendant is guilty. And all jurors must agree that the prosecution has met this minimum. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           This standard is affected by how the jury perceives your criminal intent — or lack thereof. This is because the idea of reasonable doubt doesn't just apply to the overall crime. It also applies to each element that makes up a crime, including whether or not the accused had criminal intent.            A misdiagnosis occurs when a medical professional makes an inaccurate diagnosis or fails to notice or diagnose an illness that a competent healthcare provider would have recognized. A misdiagnosis increases the risk of receiving the wrong treatment, experiencing a delay in treatment, or worsening the illness. Because of how crucial timing is in medicine, this might result in significant injury or even death.
          &#xD;
    &lt;/span&gt;&#xD;

           The probation system is designed to allow some convicted persons to serve part of their jail time outside of incarceration. A set of rules is drawn up by the court, and the probationer must agree to follow those rules. The person gains significant more freedom of movement and choice, but they are still part of the corrections system. It's not a get out of jail free card by any means.

           Probation is a right, not a privilege. Therefore, the court will inform the probationer of the specific conditions they must follow. These vary by jurisdiction and the particular details of the person and their case. However, the most common conditions include:

    &lt;span&gt;&#xD;

           Some of these rules can seem onerous, but they are preferable to spending the full time in jail. 
          &#xD;
    &lt;/span&gt;&#xD;

      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           What Happens If You Violate Probation?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

           If you do end up violating your probation for whatever reason, what happens next? In general, the probation officer notifies the court of the violation. The court will review it and determine if an arrest warrant should be issued. If you are arrested for this violation, you will attend a hearing before the judge to defend your actions. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           This hearing can go in several directions. The judge may not find that it was more likely than not that you did violate your probation. You can usually continue on as before.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           If the judge does agree you violated the terms, they have a wide range of choices for dealing with it. They may give you new, additional terms to abide by (such as additional monitoring or new community service). Your probationary sentence may be extended. Or you may be sent to jail instead.

  &lt;/p&gt;&#xD;

           How Can You Defend Yourself?
          &#xD;

    &lt;/span&gt;&#xD;

           The consequences of probation violations are serious, so you need to use your hearing to mount the best defense possible. Perhaps you did not intend to violate your probation. For example, were you invited to an event with a group that included a known criminal? Perhaps you didn't know about that, and you attempted to extricate yourself but were unsuccessful. Accidental violations usually do not constitute punishable violations.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

           In some cases, you may not have actually committed the violation. Maybe you left that group above with their criminal element but are accused of participating in some crime with them. You could bring forth witnesses to testify that you were not with the offending group.

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           Of course, maybe you did make a mistake that caused a violation. Rather than trying to debunk the accusation, you can point out to the judge that it was your first time. Own up to the bad call and stress how well you have otherwise been doing in following the rules. You can still minimize the consequences of this violation.

Whether you must navigate just one or both, one key to success is to understand how they differ and how they are similar.   &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           1. Purpose
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           As its name implies, the justice system's purpose is to administer justice. However, its two arms — civil and criminal — are concerned with different forms of justice.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Criminal justice's primary goal is to ensure justice for society on a larger scale, dealing with crimes against the state, its laws, and its citizens. Civil law is generally about resolving disputes between parties. These disputes can be small and personal, such as neighbor or contract disputes, or they can be large, like class action suits involving thousands of wronged individuals. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           2. Punishment
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Punishments for criminal convictions can be much more serious than civil ones. In general, a civil trial usually ends in a judgment regarding one side paying the other financial damages, but it can also order a defendant to cease doing something offensive, fulfill a contract agreement, or cede something. These can be financially or personally difficult, but they don't rise to the same level as incarceration or worse.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In addition, the consequences of a criminal conviction can be far-reaching. A person might be sent to jail for years. They can have many hours of community service, long periods on probation, future issues getting a job, or loss of other civil liberties. So legal counsel must approach both their case and settlement negotiations differently. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           3. Criminal Cases
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Because criminal cases can result in such serious consequences — putting a person's life and liberty in jeopardy — criminal defendants have a few specific legal rights that civil litigants don't. Perhaps the most important is the right not to self-incriminate. This Fifth Amendment right is reserved for criminal self-incrimination. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           When charged with a criminal offense, the defendant also benefits from the constitutional requirement that prosecutors reveal all evidence that could exonerate them or lessen their punishment. It can take the form of anything from video footage providing an alibi to knowledge that a witness may have been unfairly biased.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           4. Burden of Proof
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The burden of proof refers to how much a jury must be convinced that the defendant did what they're accused of. Due to the serious nature of a criminal conviction, the burden of proof on prosecutors is higher than what a plaintiff must achieve. In general, the jury must be convinced beyond a reasonable doubt.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            However, the civil burden of proof tends to be based on things like a preponderance of evidence, clear and convincing evidence, or that something was at least
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;

           The different burdens of proof mean that when both a criminal and civil trial occurs related to the same incident — such as a drunk driving accident — results can be very different. A defendant may not be declared guilty beyond a reasonable doubt, but they may lose a civil trial.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           5. Right of Appeal
          &#xD;
    &lt;/span&gt;&#xD;

           Both civil and criminal trials have a built-in right of appeal. However, criminal cases only permit the defendant to appeal. The prosecution usually does not have this right once the trial is over and a judgment entered. Civil law allows one or both sides to appeal any number of issues that came up during the trial.

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
